Soaq Terms of Service

These Terms are the agreement between you and Spicy Corp (“Spicy Corp,” “we,” “us”) for the Soaq hot springs finder app for Android and iOS (the “App”). By downloading or using the App, you agree to them. If you don’t agree, please don’t use the App.

1. What Soaq is

Soaq helps you discover and plan trips to hot springs. The location details, descriptions, photos, access notes, and other information in the App are provided for general informational and planning purposes only. We gather this information from public sources and our own research, and while we work to keep it accurate, we can’t guarantee that any listing is current, complete, or correct.

Hot springs carry real risk—you go at your own. Natural hot springs are not maintained, supervised, or operated by us. They can involve scalding or unpredictable water temperatures, unstable ground, wildlife, difficult terrain, remote locations without cell service, and changing conditions. Some springs sit on private land or land where access is restricted or seasonal. You are solely responsible for confirming that a spring is legal to access, safe to enter, and appropriate for your ability before you go, and for your own conduct once you’re there. You assume all risks of using the information in the App, and to the fullest extent permitted by law you release Spicy Corp from any claim arising out of your visit to any location.

2. Who can use it

You must be at least 13 years old to use the App, and old enough to form a binding contract where you live. If you’re under the age of majority, you may only use the App with the involvement of a parent or guardian. The App is not directed to children under 13.

3. Subscriptions and payments

Some features require a paid subscription (“Soaq Premium”). Subscriptions are sold through the Apple App Store or Google Play and managed on our behalf by RevenueCat. Pricing and available plans are shown in the App before you buy.

• Auto-renewal. Paid subscriptions renew automatically for the same period at the then-current price unless you cancel at least 24 hours before the end of the current period. Your store account is charged for renewal within the 24 hours before the period ends.
• Managing and cancelling. You manage or cancel your subscription in your Apple App Store or Google Play account settings, not inside the App. Cancelling stops the next renewal; it doesn’t retroactively refund the current period.
• Refunds. Purchases are handled by Apple or Google, so refunds are subject to their policies. We generally can’t issue refunds directly for store purchases.
• Free access. Any free tier, trial, or limited daily access we offer may be changed or discontinued at our discretion.

If you bought through the App Store, Apple’s standard Licensed Application End User License Agreement also applies, and Apple and its subsidiaries are third-party beneficiaries of these Terms with the right to enforce them against you.

4. Your trips and content

The App lets you save springs, build trips, and keep notes. This content is yours. Much of it lives on your device; where a feature lets you share a trip, you’re responsible for what you choose to share and with whom. Don’t use the App to share anything unlawful, or to encourage trespassing or unsafe access to a location.

5. Acceptable use

Please don’t: reverse engineer, copy, scrape, or resell the App or its data; use it to break the law or infringe anyone’s rights; interfere with its operation or security; or misrepresent your affiliation with us. We may suspend or limit access if the App is being misused.

6. Our intellectual property

The App, its name and branding, its design, and its compiled content are owned by Spicy Corp and protected by law. We grant you a personal, non-exclusive, non-transferable, revocable license to use the App for your own non-commercial use, subject to these Terms and your app store’s terms. We reserve all rights we don’t expressly grant.

7. Third-party services

The App relies on third parties, including Apple and Google for distribution and payments, RevenueCat for subscription management, Cloudflare for content delivery, and mapping providers. Your use of those services is governed by their own terms and privacy policies, and we’re not responsible for them.

8. Disclaimers

The App is provided “as is” and “as available,” without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, non-infringement, and any warranty about the accuracy, safety, or availability of any location or information. We don’t warrant that the App will be uninterrupted or error-free.

9. Limitation of liability

To the fullest extent permitted by law, Spicy Corp will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any personal injury, property loss, or damages arising from your access to or visit to any hot spring or other location, or from your use of the App. Our total liability for any claim relating to the App is limited to the greater of the amount you paid us for the App in the twelve months before the claim, or twenty US dollars (US $20). Some jurisdictions don’t allow certain limitations, so parts of this section may not apply to you.

10. Indemnification

You agree to indemnify and hold Spicy Corp harmless from claims, losses, and expenses (including reasonable legal fees) arising out of your misuse of the App, your violation of these Terms, or your visit to any location.

11. Changes

We may update the App and these Terms from time to time. When we change the Terms, we’ll post the revised version here with a new effective date. If you keep using the App after a change takes effect, you accept the updated Terms.

12. Termination

You can stop using the App at any time. We may suspend or end your access if you breach these Terms or if we discontinue the App. Sections that by their nature should survive, including the safety release, disclaimers, liability limits, and indemnification, survive termination.

13. Governing law

These Terms are governed by the laws of the State of California, United States, without regard to its conflict-of-laws rules, and you agree to the exclusive jurisdiction of the state and federal courts located in California for any dispute not resolved through your app store. This section doesn’t override mandatory consumer-protection rights you have where you live.
